1.     Acceptance of Policies and registration conditions

The following The Human Design Conference Registration Terms & Conditions (the “Terms & Conditions”) apply to all The Human Design Conference events. Prior to your registration, you must acknowledge and accept the Terms & Conditions contained herein. Should you not wish to accept the Terms & Conditions you should not register.

Submission of a registration is regarded as affirmation of your acceptance of the Event Terms & Conditions.
DEFINITIONS
 
‘Content’ means any and all Event material, including but not limited to videos, text, images, audio, workbooks, assignments and interactive activities accessed as part of our Events.
 
‘Event’ means any event, including The Human Design Conference Australasia, being run by Human Design Conference, HumanDesignConference.com.au.
 
‘We’, ‘our’ and ‘us’ means Human Design Conference, HumanDesignConference.com.au and includes all officers, directors, employees, contractors and affiliates.
 
‘You’ and ‘your’ means any participant in our Event or user of our website.

2.     Privacy Policy

2.1 We respect your privacy 
(a) We respect your right to privacy and are committed to safeguarding the privacy of your personal information. We adhere to the Australian Privacy Principles contained in the Privacy Act 1988 (Cth). How we collect and treat your personal information is hereby incorporated into these Terms & Conditions. 
 
(b) "Personal information" is information we hold which is identifiable as being about you.

2.2 Collection of personal information 
(a) We will, from time to time, receive and store personal information you enter onto our website, provided to us directly or given to us in other forms.
 
(b) You may provide basic information such as your name, phone number, address and email address to enable us to send information, provide updates and process your participation in our events. We may collect additional information at other times, including but not limited to, when you provide feedback, when you provide information about your personal or business affairs, change your content or email preference, respond to surveys and/or promotions, provide financial or credit card information, or communicate with our customer support.
 
(c) Additionally, we may also collect any other information you provide while interacting with us.

2.3 How we collect your personal information 
(a) We collect personal information from you in a variety of ways, including when you interact with us electronically or in person, when you access our website and when we provide our services to you. We may receive personal information from third parties. If we do, we will protect it as set out in these terms and conditions.

2.4 Use of your personal information 
(a) We may use personal information collected from you to provide you with information, updates and for administering your participation in our events. This may include information about the event’s content, event logistics, payment, updates, and additional information related to the event. We may also make you aware of new and additional products, services and opportunities available to you. We may use your personal information to improve our products and services and better understand your needs.

(b) We may contact you by a variety of measures including, but not limited to telephone, email, or sms.

2.5 Disclosure of your personal information 
(a) We may disclose your personal information to any of our employees, officers, insurers, professional advisers, agents, suppliers or subcontractors insofar as reasonably necessary for the purposes set out in this Policy. Personal information is only supplied to a third party when it is required for the delivery of our events (e.g. bodygraphapp). 
 
(b) We may from time to time need to disclose personal information to comply with a legal requirement, such as a law, regulation, court order, subpoena, warrant, in the course of a legal proceeding or in response to a law enforcement agency request.
 
(c) We may also use your personal information to protect the copyright, trademarks, legal rights, property or safety of The Human Design Conference, www.humandesignconference.com.au, its customers or third parties.
 
(d) Information that we collect may from time to time be stored, processed in or transferred between parties located in countries outside of Australia.
 
(e) If there is a change of control in our business or a sale or transfer of business assets, we reserve the right to transfer to the extent permissible at law our user databases, together with any personal information and non-personal information contained in those databases. This information may be disclosed to a potential purchaser under an agreement to maintain confidentiality. We would seek to only disclose information in good faith and where required by any of the above circumstances.
 
(f) By providing us with personal information, you consent to the terms of this Privacy Policy and the types of disclosure covered by this Policy. Where we disclose your personal information to third parties, we will request that the third party follow this Policy regarding handling your personal information.

(g) During our events. The Human Design Conference event co-sponsors, exhibitors, and other third parties may directly request your personal information at their exhibit booths or presentations.  Providing your information to them is optional, and you should review their privacy policies to address your particular needs and concerns about how they will treat your personal information.

If during the event you attend a session or program hosted by an exhibitor other than The Human Design Conference, you understand and agree that when you present your badge for scanning or when you provide personal data, that information will go to a non-The Human Design Conference entity and The Human Design Conference takes no responsibility for how that company uses your personal information.

2.6 Security of your personal information 
(a) We are committed to ensuring that the information you provide to us is secure. In order to prevent unauthorised access or disclosure, we have put in place suitable physical, electronic and managerial procedures to safeguard and secure information and protect it from misuse, interference, loss and unauthorised access, modification and disclosure.
 
(b) The transmission and exchange of information is carried out at your own risk. We cannot guarantee the security of any information that you transmit to us, or receive from us. Although we take measures to safeguard against unauthorised disclosures of information, we cannot assure you that personal information that we collect will not be disclosed in a manner that is inconsistent with this Privacy Policy.

3.     Non-discrimination policy

We prohibit discrimination, harassment, and bullying against any person for any reason—for example, because of age, ancestry, colour, disability or handicap, national origin, race, religion, gender, sexual or affectional orientation, gender identity, appearance, matriculation, political affiliation, marital status, veteran status, or any other characteristic protected by law.

4.     Event Conduct and Safety

We are committed to providing a safe, productive, and welcoming environment to all participants, including staff and vendors, at our events. We have no tolerance for discrimination, harassment, or bullying in any form at our events. Participants are expected to adhere to these principles and respect the rights of others.  

4.1 Participation: You agree to participate in the event responsibly and professionally. We reserve the right to remove or restrict your access if you engage in disruptive or inappropriate behaviour.

4.2 What to Do If You Witness or are Subjected to Unacceptable Behaviour:  Participants should report any behaviour inconsistent with these principles to onsite event staff. Event staff will be happy to help participants contact venue security or local law enforcement, provide escorts, or otherwise assist those experiencing harassment to feel safe for the duration of the event. We value your attendance.

5.     Confidentiality 

5.1 Confidential Information: Both parties agree to keep any confidential information exchanged during our Events, including personal and proprietary information, confidential and not disclose it to third parties.
 
6.     Usage of photographic and video material taken during events

To comply with global data privacy laws, we impose certain restrictions on the use of multimedia at our events (e.g. photography, video, audio, online streaming, and all future mediums).  An attendee is permitted to use hand-held cameras and/or smart phones to take photographs and capture digital images for personal, non-commercial use, provided the photography is not disruptive. Photographs may not be published, sold, reproduced, transmitted, distributed or otherwise commercially exploited in any manner whatsoever.

We may hire professional service providers (photo/video/streaming/audio) to document and display the event experience.  We may also use social media (e.g. Instagram/Facebook) to:
(a) post real-time photos and videos to its social media feeds; and
(b) display select submissions from those feeds on monitors throughout the event venue. 

Attendees and sponsors are encouraged to capture their event experiences and post their own social content from the event (text, photos, audio, video, streaming), provided it does not infringe upon the rights of any attendee, sponsor, third party, or The Human Design Conference.  Such infringement would include, but is not limited to, defamation or infringement of intellectual property rights.  In the event an attendee requires a release or permission to protect the rights of a third party, obtaining such a release or permission shall be the sole responsibility of the attendee.   

By attending the event, you acknowledge and agree as follows:
(a) The Human Design Conference may edit and use footage it captures at the event for marketing and promotional activities and for any other lawful purpose in the ordinary course of its business; and
(b) due to the prevalence of mobile recording devices in today’s world, The Human Design Conference disclaims all liability for the capture of your image in any multimedia format by other attendees at the event.

7.     Payment 

Full payment for our Events will be charged upfront when signing up for our events or as a 2-part payment plan option.
 
7.1 Payment Methods: We accept payment via credit card, direct bank transfer and other methods specified on our website. Payments will be processed through third parties including Stripe.

7.2 Your booking is considered CONFIRMED once your full payment or first payment is received by Human Design Conference.
 
8.     Refund and Cancellation Policy

8.1 Application for Refund: If you seek a refund for an event, you must submit a written request to hello@humandesignconference.com.au. The request must include the reason for seeking a refund and any supporting documentation if applicable. Verbal requests for a refund WILL NOT be accepted.

8.2 Cancellation and Refund Eligibility: If you wish to cancel your registration, notwithstanding applicable Australian consumer rights, refunds will be granted in accordance with the following circumstances:

(a) Cancellation by us:
If the event is cancelled or rescheduled by The Human Design Conference, you will be entitled to a full refund of all fees paid. We reserve the right to cancel or reschedule events should the minimum number of registrants not be reached.  If an event must be cancelled or the date changed, registrants will be informed a minimum of 7 days before the start of the event.

(b) Cancellation by you:
Refunds for events are not available if you change your mind about your purchase or can no longer attend.

Payment Plan: Should you choose to pay via the 2-part Payment Plan option, and request cancellation before all payments have been made, you will still be required to pay the full amount of the ticket.

8.3 Refund Processing: Refund requests will be processed within 14 business days from the date of receipt of the written request.

Refunds will be made via the same method as the original payment. If the refund cannot be processed through the original payment method, alternative arrangements will be made in consultation with the student.

All refunds will be made in Australian Dollars (AUD).

9.     Events Beyond Control 

9.1 Force Majeure: We shall not be liable for any failure to perform our obligations due to events beyond our control, including but not limited to acts of nature, government actions, pandemics (such as COVID-19), or other unforeseeable circumstances.
 
10.  Advice and Information 

10.1 Disclaimer: Our events and any related content provided are for educational and general information purposes only and should not be considered professional advice or a substitute for professional training.
 
We do not know your personal circumstances when providing this information and it does not constitute, nor should it be treated as personal, legal, business, tax, financial or other advice of any type or nature.
 
You need to make your own enquiries and analysis to determine if any of the information is suitable for your own particular purposes and suitable for your situation and requirements.
 
We do not promise, warrant or guarantee any particular results from any of our events or information.
 
The Content presented in our Events is obtained from sources believed to be reliable and is given in good faith but its accuracy and completeness are not warranted, nor do we accept responsibility arising in any way from the data or information, including but not limited to negligence, errors or omissions.
 
The views expressed by any event attendee, speaker, exhibitor, or sponsor are not necessarily those of The Human Design Conference. 
 
11.   Linked Websites 

11.1 Third-Party Websites: We provide our events to you through third-party payment sites and other third-party websites, operating systems, platforms, and portals (collectively, "Third-Party Platforms"). Additional terms and conditions will apply to you with respect to your use of Third-Party Platforms, which are not under our control. We do not assume any responsibility or liability for your use of such Third-Party Platforms.
 
You are solely responsible for complying with any relevant terms and conditions of the Third-Party Platforms and maintaining appropriate accounts in good standing with the providers of the Third-Party Platforms. You acknowledge and agree that The Human Design Conference has no responsibility or liability for any Third-Party Platform or any Customer Data exported to a Third-Party Platform.
 
Our Event Content may contain links to third-party websites. We are not responsible for the content, accuracy, or reliability of these third-party websites. Your use of linked websites is at your own risk.
 
12.  Intellectual Property

12.1 Ownership: All our Event Content, including the information in our e-books, event material, videos, PDFs and all other digital materials (together ‘Material’) is owned by The Human Design Conference and is protected by copyright and other intellectual property laws.

12.2 Copyright: All course Material is protected by copyright and you may not share, copy or redistribute this Material in any medium or format at any time. Our Material is for your personal use only and may not be used for commercial purposes.

You are not permitted to make any derivative material, including but not limited to copying, reproducing, transforming, sharing or building upon the Material in whole or any part thereof. You must have our express written consent for any other use or distribution.

The Event Material provided to you, or presented to you during the Event, is our confidential, proprietary information for your sole use as the person purchasing or participating in the event.

13.  Australian Consumer Law (ACL) 

13.1 Consumer Rights: Nothing in these Terms and Conditions excludes, restricts, or modifies any consumer guarantees or rights under the Australian Consumer Law (ACL). Our liability for breach of any such guarantee is limited to the extent permitted by law.
 
14.  Limitation of Liability 

14.1 Liability: You agree and acknowledge that we are not liable for any direct, indirect, consequential or incidental loss or damage which may result from you accessing or attending our Events and Content or any information contained on our website or linked from it.
 
You agree that any actions you may take or decisions you may make based on information in our Events or on our website are made at your own risk and we cannot be held liable for any results or outcomes.
 
Your use of the information in our Events is entirely at your own risk and any reliance on the information should be your own decision or done with the help of a professional advisor.
 
For the sake of clarity, in no event will we be liable for any direct, indirect, consequential, incidental or special damages of any kind including any damages for loss or injury.
 
We will not be held liable for any issues related to internet connectivity or technical difficulties experienced by you while accessing the Events or Content.
 
Certain legislation, including the Australian Consumer Law (‘ACL’) in the Consumer and Competition Act 2010 (Cth) and similar consumer protection laws and regulations, may confer you with rights, warranties, guarantees and remedies relating to the provision of services by us to you which cannot be excluded, restricted or modified (‘Statutory Rights’).
 
Our liability is governed solely by the ACL and these Terms. We exclude all conditions and warranties implied by custom, law or statute except for your Statutory Rights.

14.2 Liability waiver and release: In consideration of being allowed to register for, and participate in the Event, you hereby warrant and represent that you are age 18 or above and freely waive, release from liability, assume all risks, and covenant not to sue The Human Design Conference or its members, employees, board members, agents, or volunteers for any expense, loss, damage, personal injury, including loss of life, illness, including but not limited to COVID-19, disability, property damage, or property theft or actions of any kind that you may hereafter suffer or sustain before, during, or after the event, unless said expense, loss, damage, personal injury, including loss of life, illness, disability, property damage or property theft or actions of any kind is caused by the sole, gross negligence of The Human Design Conference. This Liability Waiver and Release is specifically binding upon your heirs and assigns and is knowingly given. 

15.  Dispute Resolution 

15.1 Resolution Process: If you have a complaint or dispute, please contact us to attempt to resolve the issue informally. If a resolution cannot be reached, any disputes will be subject to mediation or arbitration in accordance with The Human Design Conference, as provided on our website.
 
16.  General

The Human Design Conference reserves the right to change, amend, add or remove any of the above Terms & Conditions in its sole discretion and without prior notice. If one or more of the conditions outlined in these Terms & Conditions should become invalid, the remaining conditions will continue to be valid and apply. These Terms & Conditions apply to all event participants (attendees, speakers, sponsors, exhibitors).

16.1 Assignment: You may not assign or transfer your rights or obligations under these Terms and Conditions without our prior written consent.
 
16.2 Severance: If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
 
16.3 Entire Agreement: These Terms and Conditions constitute the entire agreement between you and The Human Design Conference regarding registration and participation in our events.
 
16.4 Waiver: Failure to enforce any provision of these Terms and Conditions shall not constitute a waiver of such provision.
 
16.5 Governing Law: These Terms and Conditions are governed by the laws from time to time in force in Queensland of Australia. Both parties agree to unconditionally submit to the exclusive jurisdiction of the Courts of Queensland for determining any dispute concerning these Terms.
 
By registering for our events, you acknowledge that you have read, understood, and agree to abide by these Terms and Conditions.
